Course Description:

Depreciation recapture is where Form 4797 gets expensive for farm clients —
and where assumptions from other practice areas fail most visibly.
Equipment depreciated at 100% bonus carries zero basis: the full sale price
up to original cost is ordinary income, not capital gain. A farm building that
received bonus treatment can face recapture at ordinary rates, not the 25%
cap many practitioners expect. Farmland sold within ten years of
conservation expenditures gives back a fraction of every dollar deducted. ​

This course works through the recapture mechanics that complete the Form
4797 picture for farm dispositions: Part III calculations for equipment,
buildings, and farmland and Part IV calculations when business use drops
below 50%.​

Learning Objectives 

By the end of this course, participants will be able to: 

1. Calculate the depreciation recapture on the sale of farm personal property and Section 1245 real property. 

2. Distinguish the Section 1250 ordinary recapture component from unrecaptured Section 1250 gain on the sale of farm buildings. 

3. Determine the recapture amount on farmland where soil and water conservation deductions have been previously claimed. 

4. Determine the recapture amount under Part IV when business use of farm property drops to 50% or less. 

5. Identify the reporting party for Section 179 recapture when a pass-through entity disposes of property on which the deduction was previously claimed.
